Terms & Conditions

Terms and Conditions of Hire that you agree to with Hiring Us

1. Hire agreements can only be made by persons aged 18 years of age or over
The hiring customer will be held responsible for the conduct of all passengers within their party. Ocean Classic Cars reserves the right to terminate the charter immediately, without refund if passengers become unruly or abusive.  When a person under the age of 18 makes an inquiry about a school ball, their parent/guardian must enter into the agreement on
their behalf.


2. A booking fee of $150 per vehicle is required to secure a booking
All reservations must be confirmed with a booking fee of $150 by cash, or bank transfer.
Should cash be the preferred method of payment we require a credit card number to be provided for security purposes. By making payment of your booking fee, it is deemed that you have read, understood, and agreed to these terms and conditions. Only 50% of the booking fee is refundable if the client cancels or changes their mind up until 7 days before the service. A booking confirmation will be issued at the time of booking noting the booking fee has been paid. This booking fee will come off from the total cost of your booking.


3. The balance of the account
For bookings over $600: the balance owing is required 21 days prior to the event, by bank transfer or cash in person.
For bookings below $600: the balance owing is required on the day of the service, by bank transfer or cash in person.
Payment of the booking fee is acceptance of the terms and conditions of the hiring of the service and an acknowledgment of responsibility and liability for the full balance due. All balances owed and not finalised will be charged to the hirer using the credit card provided at the time of booking.


4. Changes to the schedule
Changes to a booking schedule must be communicated to Ocean Classic Cars via E-mail only.
Please ensure that all changes to the schedule are reflected in the final confirmation E-mail you will receive on the week of the service.
Changes made seven days before the arranged date and/or in the week leading up to the arranged date, after the drivers have been scheduled, can lead to confusion and duplicate instructions and are best avoided whenever possible.


5. Final confirmation
Final confirmation of the schedule is given by Ocean Classic Cars 7 days before the service is to be rendered. If you require any changes to your service date, please ensure you do so in writing via E-mail.

6. Overtime rates
In the case that the service runs overtime due to the client’s lack of punctuality, charges of $150 per 30 mins or part thereof will apply. Overtime rates will not apply for unforeseen circumstances such as traffic.
Running overtime can be a source of frustration and stress for drivers who may have commitments following your service, so we recommend that you build some time into your booking schedule for unexpected delays on the day. You, the hirer, agree that all follow-up charges for overtime shall be paid after the service.


7. Seating capacity
Seating capacity, excluding driver, is 3 persons maximum per car.


8. All vehicles are non-smoking, including vaping.
Should this standard condition be ignored the drivers are instructed to terminate the charter immediately, without refund if a member of your party smokes in the vehicle.


9. Damage and/or soiling of the cars
Please note we do not allow food in our vehicles. Should this condition be ignored our drivers are authorised to terminate the hire agreement immediately and a refund will not be offered under any circumstances. Damage or soiling of the cars caused by the party (including upholstery damage, spillage, and soiling) will be charged to the hiring customer.
You, the hirer, agree that all follow-up charges for damages or excessive soiling/cleaning shall be charged to your credit card. The cleaning and sanitising fee for soiling is $250, damage at cost. Repair costs will be invoiced and deducted from the credit card used for booking.


10. Photographs
Photography featuring the vehicles is permitted and the drivers will assist to position the vehicles as requested by the photographer. The drivers have the final decision on how the vehicles can or will be placed at a location.
Photographs featuring the vehicles and event may be taken by Ocean Classic Cars drivers for promotional use by Ocean Classic Cars. Copyright for these images belongs to Ocean Classic Cars and they are available free of charge to the person responsible for the hire.
Please note our drivers are not photographers and images might not be to your satisfaction, so we suggest hiring a professional photographer for your event.


11. In the event of an unforeseen accident or breakdown
Ocean Classic Cars reserve the right to substitute an alternative vehicle to those originally booked. In the event of an unforeseen accident or breakdown before or during a service, Ocean Classic Cars will not be held liable for compensation beyond the cost of the car hire for the time the booked vehicle or replacement vehicle was not in service.
We advise you to take out suitable wedding insurance in case something unforeseeable should disrupt or cause your wedding to be canceled or postponed at the last minute.
Sometimes, particularly on a Friday night, and even though we allow plenty of time, traffic in Perth may not allow us to get to your pick-up location on time. In this situation, we will do everything we can to make it up to you, but no refunds will be offered.

Vehicle system (i.e. air-conditioning, stereo, etc) failures, whilst rare, can happen either before or mid-way through a charter. If any vehicle system failure occurs, prior to or during a service, but the vehicle is mechanically capable of completing the charter, it will do so and no compensation will be offered or payable.


Whilst every effort is made with regard to the maintenance of our vehicles, mechanical breakdowns can and do occur on classic cars. We will make every effort to provide a replacement vehicle as soon as possible, but will not reimburse a client that decides to take it upon themselves to book alternative means of transport. 


12. School ball bookings
It is an offense under the Liquor Control Act 1988 for any person to consume alcohol on board the vehicle when the purpose of the charter is a school-based function, regardless of whether the person consuming the alcohol is 18 years and above or not. Our drivers are authorised to terminate charters immediately if alcohol is being consumed and a refund will not be offered under any circumstances.


13. Liquidated damages
Any claim for liquidated damages, consequential loss, or any other eventuality shall not be admissible.
In all cases, the owners, operators, and chauffeurs at Ocean Classic Cars’ maximum liability shall be limited to a full refund of monies paid pertaining only to the trip in question.


14. Venue accessibility
Due to the nature of our classic cars, access to some venues, suburban streets and driveways may be restricted and pickup/drop-offs at the front door may not be achievable.
Shall that be the case we will notify you promptly and a suitable alternate pick-up point will be identified.
Drivers reserve the right to refuse passage to any venue that they deem unsafe to the vehicle or passengers.


15. Quote Expiration
The quote expires 30 days after the date of issue.


16. Privacy
Personal information submitted to and/or obtained by Ocean Classic Cars will only be used for the purpose of conducting our car hire services and the associated company’s on-line marketing, including social media. Please let us know if you don’t want details and/or pictures (point 10 above) published on our social media.
Some details like names and phone numbers might be passed to staff and/or drivers as it is required to manage the hire services.
Data retention, as required by Government agencies, is managed using secure facilities.
Your personal information will not knowingly be passed on to a third party outside of these operating guidelines.

18. Wine Tour Conditions
Please note: after you have paid your deposit the next thing you will need to do is contact the venues you and your group wish to attend. Once you have confirmed your venues and times, please send your itinerary to us so we can add it to your booking. Ocean Classic Cars will not be ‘time-keepers’ and it is up to you to be on time for your venue bookings.
Every venue you wish to attend requires a booking. Limousines will be turned away without a booking. Full payment will be required if the tour is canceled due to failure to book venues. Please understand that you as the hirer are responsible for your guests throughout the day.
If a group is refused entry to a venue, Ocean Classic Cars are within its rights to terminate the charter and return to initial pick up with no refunds and full monies paid.
Any fights and/or anti-social behaviour in an Ocean Classic Cars vehicle are not tolerated and the charter will be terminated.
Please understand your group will be exposed to a lot of other families and other groups while on charter, it is the hirer’s responsibility to ensure your group is under control. Any damage/theft at any venue will be the responsibility of the hirer to provide information regarding if such an incident arises.
Ocean Classic Cars is within its rights to pass on details of the groups in question relating to any incidents and will not be held liable for any damages or theft caused by groups while on charter.
